The shooting of Robert Dotson, 52, in the northwestern New Mexico city of Farmington prompted a civil lawsuit by his family members, though public prosecutors found there was no basis to pursue criminal charges against officers after a review of events. The suit alleged that the family was deprived of its civil rights and officers acted unreasonably.

Hearing a knock at the door late on April 5, 2023, Dotson put on a robe, went downstairs and grabbed a handgun before answering. Police outside shined a flashlight as Dotson appeared and raised the firearm before three police officers opened fire, killing him. Dotson did not shoot.

“Ultimately, given the significant threat Dotson posed when he pointed his firearm at officers ... the immediacy of that threat, the proximity between Dotson and the defendant officers, and considering that the events unfolded in only a few seconds, the court finds that the defendant officers reasonably applied deadly force,” U.S. District Court Judge Matthew Garcia said in a written court opinion.

The judge also said the officers were entitled under the circumstances to qualified immunity — special legal protections that prevent people from suing over claims that police or government workers violated their constitutional rights.

And there it fucking is.

"Qualified immunity" has very few qualifications.

Good thing everyone had a gun, for safety

[–] [email protected] 34 points 1 month ago (5 children)

Maybe things would turn out better if everyone wielded two guns, maybe three.

[–] [email protected] 12 points 1 month ago (1 children)

With tariff's kids may only get one gun this Christmas. Instead of 2 or 3, or 14.

Little kids age 17, 5, maybe even 10, 11, or 13.

Just one more gun, bro. Bro, I swear

Nipple piercings that can't support, hold & fire a handgun are getting banned.

Genitalia that can't do the same too.

Also any birds on private property should let the owner of that property access their firepower & auto-targeting.

I think everyone should drive around in a tank, and shoot first, ask questions later

[–] [email protected] 2 points 1 month ago

What's with all the questions all of a sudden??

Three Gun Style: Ham... BURGER!

[–] [email protected] 2 points 1 month ago

And everyone should have a bigger one than everyone else.

[–] [email protected] 5 points 1 month ago

As if being unarmed prevents being shot dead by police.

[–] [email protected] 4 points 1 month ago (1 children)

They didn't need a gun to murder George Floyd.

So if I want to kill someone all I have to do is knock on their door late at night and wait for them to brandish a firearm?

[–] [email protected] 82 points 1 month ago

And be in the most important protected class: cop.

[–] [email protected] 3 points 1 month ago

Only if you're a cop. If you're not a cop, you have to call the anonymous cop tip line and tell them you heard shouting and smelled marijuana.

Obviously don't do this. People could end up for real dead.

[–] [email protected] 34 points 1 month ago (2 children)

Looks like an endless spiral of gun violence. A bit like Schrödingers gun ownership law. You are allowed to own a gun and you are allowed to protect yourself and your family with a gun - but then you are not allowed to do so when the police is at your door, cause they have the right to shoot you if you own a gun and use it to protect yourself.

Just wow. But guns are never the problem, am I right?

Ah and of course ACAB, like seriously

[–] [email protected] 14 points 1 month ago (1 children)

The monopoly on violence is real

Police State Things ✨💅

[–] [email protected] 10 points 1 month ago (1 children)

it seems to me that, given qualified immunity, and the cavalier attitude of cops with guns, it's reasonable to make preemptive strikes against law enforcement for your own self defense.

i don't think it's illogical to say that every dead cop makes this country safer.

[–] [email protected] 3 points 1 month ago

I learned long ago there are only 2 kinds of cops.

Bad cops and worse cops.

[–] [email protected] 9 points 1 month ago (4 children)

I’m very anti cops, but as I read how he pointed the gun, I have a hard time supporting this lawsuit. The part about showing up at the wrong address I can still support unless the caller told them specifically his address. I didn’t continue reading at that point because I lost interest when he raised his firearm.

[–] [email protected] 47 points 1 month ago (1 children)

So whats your favorite flavor of boot? Seeing as how you lick them so willingly you must have a preference.

The story does not specify whether or not the officers ever identified themselves. If they didn’t, then from his perspective he went to answer his door only to have a bright light in his face.

[–] [email protected] 6 points 1 month ago (1 children)

Yeah because it is 100% reasonable to answer a door while holding a gun. Something a normal person does. Completely sane.

Oh no wait, a normal person would just not open the door, or call the police themselves, or yell asking "who is it". Imagine someone got hurt in an accident, they ran up to a house and got greeted by a handgun. Then the story wouldn't be "fuck the cops" it'd be "fuck guns and the lunatic wielding them".

[–] [email protected] 19 points 1 month ago (1 children)

I agree that opening the door was a mistake - I’m the type to check a camera when I hear a knock.

I think you’re missing the point of my comment. The firearm was likely pointed in response to the blinding light. Your hypothetical “person hurt in an accident” probably would not have had a gun pointed in their face.

By being unable to fathom why somebody would have the means to defend themselves when a stranger is at their door, you’re displaying a certain level of privilege. Must be nice.

[–] [email protected] 3 points 1 month ago (1 children)

He grabbed a handgun before answering the door. It doesn't matter if he pointed it, if he waved it, or shown them how cool he looked with it. You don't open the door with a gun in hand. What's the A to Z of doing that? If it's robbers, do you think you opening the door with a gun makes them magically disappear? What if it's literally anyone else, because why would a robber knock on the door?

You call it a lack of privilege and I call it stupidity. Grabbing a gun means "I'm about to use deadly force". Grabbing a gun to a situation that isn't known to you is escalating everything to 11. As I said. If you are scared, you don't open the door. Someone breaks in, sure, use that deadly force. But this isn't that, this is a flashlight being pointed at a dude who knowingly got something that can end another person's life, who overreacted and literally pulled a gun on cops.

[–] [email protected] 23 points 1 month ago* (last edited 1 month ago) (1 children)

you have a right to hold a gun in your own home

if this were anyone but a cop this would be murder

[–] [email protected] 3 points 1 month ago (3 children)

You have a right to hold a gun in your home. You don't have a right to point said gun at people at your door. No matter if this was a cop or not.

Seriously, people lose all common sense once cops are involved because acab. When the reality often is "you are trying to defend a dude that pulled a gun on people who were at his door".

[–] [email protected] 10 points 1 month ago* (last edited 1 month ago) (5 children)

you come to his door late at night?, don’t announce yourself, multiple unknown people in a group, shine a light in his face and it’s his fault the reaction is to point his gun? stupid fucks were not even at the right location

this shit should have been done in broad daylight if they are going to be so incompetent

the beginning of your second sentence sure is correct lol…

Proceeds to be pro cop.

Fucking bootlickers are all the same and they think the rest of us are as stupid as they are.

Maybe they shouldn't of shone a light at him making him unable to identify that it was cops. They used the light for obfuscation and it ruined his target recognition. It's still their fault. It's all their fault.

USA, land of the free where you first encourage people to have their own firearms for self defense and then shoot them for it

[–] [email protected] 5 points 1 month ago

That's what he gets for checks notes... living at the wrong address.

Methinks that "qualifications" didn't factor in to this immunity at all.

[–] [email protected] 2 points 1 month ago

Did the police cars have theirs lights on? If Dotson failed to notice that, then is paranoia prevailed too.

[–] [email protected] 2 points 1 month ago

Did you know that many states in the US have more gun deaths per capita than Ukraine during an active war?
